ONLINE COMMUNICATION CLARIFICATION AND EXPLICIT CONSENT TEXT

This Clarification Text has been prepared by Akc Mobilya Forest Products Tourism Construction Import Export Industry and Trade Limited Company, in its capacity as data controller, pursuant to Article 10 of Law No. 6698 and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform.

1. Personal Data Processed as Data Controller
Within the scope of your application (such as online job application), suggestion, complaint, or online visit made to our company via our website, social media, or info email, your personal data listed below may be processed in accordance with the Personal Data Protection Law No. 6698, in the capacity of data controller: Identity Information (Full Name), Contact Information (Phone, Email).

2. Purposes of Processing Personal Data
Your personal data collected by the company may be processed for the purposes specified in Articles 5 and 6 of the Law No. 6698 and listed in the VERBIS system where our company is registered, based on the reason you shared your personal data with us.

  1. To Whom and for What Purposes Personal Data May Be Transferred

Your personal data may be transferred to authorized public institutions or organizations, within the framework of the personal data transfer conditions specified in Article 8 of the Law, in order to legally protect the rights of the Company, fulfill legal obligations, and achieve the purposes specified above.

  1. Method and Legal Grounds for Collecting Personal Data

The personal data of customers who contact us via social media accounts, our website, or info email regarding the products and services offered by our company, as well as job applicants and online visitors, are processed by our company. Your personal data may be processed based on the legal grounds specified in Article 5 of Law No. 6698: “explicitly provided by laws,” “data processing is necessary for the legitimate interests of the data controller, provided that it does not violate the fundamental rights and freedoms of the data subject,” or “necessary for the data controller to fulfill its legal obligation.”

  1. Accuracy and Updating of Personal Data

Pursuant to Article 4 of the Law, data controllers are obliged to keep personal data accurate and up-to-date. The data subject declares and undertakes that the personal data shared with our company is accurate and will be updated in case of any changes. The data subject also agrees to be contacted periodically by our company to ensure accuracy and timeliness of the data.

  1. Retention Period and Disposal

Personal data processed within this scope shall be retained for 10 years in accordance with the relevant legislation and, in the absence of any legal claim by either party within this period, shall be destroyed during the first periodic disposal period following the expiration of the 10 years.

7. Your Rights Under Article 11 of the Personal Data Protection Law
If you, as the data subject, have any requests regarding your rights specified in Article 11 of Law No. 6698, you can fill out the Data Controller Application Form available from our company or website, or prepare your own petition, and submit it via one of the following methods:

– Via registered electronic mail (REM), secure electronic signature, mobile signature,
– By using the email address previously provided to our company and registered in our system,

We will respond to your request as soon as possible and within no later than thirty days, free of charge, depending on the nature of your request. However, if the process requires an additional cost, the fee determined by the Personal Data Protection Board may be charged. As the data subject, you have the following rights:

  1. a) To learn whether your personal data is being processed,
  2. b) If your personal data has been processed, to request information about it,
  3. c) To learn the purpose of processing your personal data and whether it is used in accordance with the intended purpose,
  4. ç) To know the third parties to whom your personal data is transferred domestically or abroad,
  5. d) To request the correction of your personal data if it is incomplete or incorrectly processed,
  6. e) To request the deletion or destruction of your personal data within the framework of the conditions set forth in Article 7 of the Law,
  7. f) To request that transactions made pursuant to subparagraphs (d) and (e) be notified to third parties to whom the personal data has been transferred,
  8. g) To object to the occurrence of a result against you by analyzing the processed data exclusively through automated systems,
  9. ğ) To demand compensation for damage in case of loss due to unlawful processing of personal data.
